Tim concentrates his practice in civil litigation, with an emphasis on business disputes. He represents companies and individuals in a variety of cases involving products liability, intellectual property, real estate and construction, and other commercial matters. He has tried jury and bench trials in federal and state courts, and has assisted clients in resolving disputes in mediations, arbitrations, and judicial settlement conferences. Tim also serves as local counsel for national and international firms, representing clients with cases pending in Indiana's state and federal courts.
Tim formerly practiced business litigation as an associate with a national firm headquartered in Milwaukee. He moved back to South Bend and joined a civil litigation boutique firm in 2003. In 2008, he co-founded LaDue Curran & Kuehn LLC.
Since returning to practice in Indiana in 2003, Tim has represented international corporations, regional businesses, and individuals, including:
- six major motion picture studios and a national motion picture association in several infringement suits over copyrighted films;
- an international manufacturer of vehicle and industrial application components in a fraud action;
- a national manufacturer of lawn and garden products in a case involving the design and manufacture of snow blowers;
- a Fortune 25 technology corporation, as local counsel, in multiple lawsuits relating to the sale of computer software and hardware;
- a world leader in the processing of fluoropolymers and other high-performance resins in breach of supplier contract actions;
- a major manufacturer of audio-visual equipment in a trade secrets lawsuit;
- a young bicyclist in a premises liability and negligence suit action against a college;
- an international orthopedic manufacturer, as local counsel, in a complex patent infringement action over knee replacement systems;
- one of the leading food and beverage companies in the country in a lawsuit involving a multi-state dairy products recall;
- an international manufacturer of suture systems, as local counsel, in a "bet the company" patent infringement action;
- a leading global financial services company in several breach of contract actions involving home mortgages;
- a national manufacturer of recreational vehicle components, as local counsel, in a large patent infringement action over RV steps;
- a national wheel and tire supplier in a trademark infringement action involving designs of aluminum wheels;
- one of the nation's largest franchisee restaurant companies in a land dispute;
- a national bank in many breach of contract actions involving commercial loan agreements; and
- an international consulting services company, as local counsel, in a breach of contract action involving a consulting software system.
In addition to Indiana's state and federal courts and the United States Court of Appeals for the Seventh Circuit, Tim is admitted to practice in Wisconsin and has handled matters in the Eastern and Western Districts of Wisconsin and the Eastern and Western Districts of Michigan. Tim is a member of several local, state, and national bar associations and groups. Currently, he serves as a representative for the Federal Judicial Committee and a representative for the State Legislation Committee of the Indiana Bar Association. He also is Indiana's Membership Coordinator for the Business Torts Committee of the American Bar Association.
Tim has authored several published articles on topics including manufacturer liability for unforeseeable design defects and post-litigation confidentiality agreements.
Tim was born in Northern California and raised in the South Bend area. He graduated magna cum laude with a Bachelor of Science in pre-law studies from Marquette University and with a J.D. from the Notre Dame Law School. He also studied European Community law while a scholar at University College Galway, Ireland. Law & Politics Magazine and Indianapolis Monthly Magazine named Tim as an "Indiana Rising Star" in 2010.
